do I need an EPC?
You will have a statutory obligation to provide one in accordance
with the ‘Energy Performance of Buildings (Certificates and Inspections)
(England and Wales) Regulations 2007’.
This has evolved from the
Government’s acceptance of the ‘Kyoto Agreement’ and the EU’s ‘Energy
Performance of Buildings Directive’
What’s the position in Scotland and Northern Ireland?
Regulations have been introduced here during 2008, broadly in line
with the provisions in England and Wales.
When must I provide one?
On a sale or letting of a property:-
• At the earliest opportunity
• And
before entering into a contract to sell or rent,
• Or
if sooner when providing written information to a prospective
buyer or tenant,
• Or when they first view the property.
Where a building is constructed:-
• No later than 5 days after the construction work has been completed.
An EPC is also required in specific circumstances when a building
is modified structurally or in relation to fixed services.
What happens if I do not get a certificate?
Enforcement action can be taken by Trading Standards resulting in
prosecution and a fine – currently set at a minimum of £500 and a
maximum of £5,000.
Can I charge for providing one?
No. The Regulations state that they must be provided free of charge
to any prospective buyer or tenant.
